No fewer than 20 persons are feared dead following a suicide bomb attack on a Catholic Church in Kaduna State.
The church, Saint Rita’s Catholic Church, Malali, Kaduna, Kaduna State, was struck at about 8am by the suicide bomber operating in a car.
The explosive was said to have been planted in the car.
Several others were injured.
The injured, according to the Head, Public Relations, National Emergency Management Agency, Yushau Shuaib, have been evacuated to hospitals in Kaduna metropolis.
Shuaibu said he could not confirm the actual casualty figure, adding that the agency was doing its best to manage the situation.

Tuesday, 30th October, 2012 will herald the commencement of a well grounded legal process cum battle for the actualization of the independence of Biafra Republic through legal means at Owerri Federal High Court, Imo state.
The Case for Self-determination and Independence of Biafra: Suit No. FHC/OW/CS/102/2012
On behalf of the Indigenous People of Biafra, Bilie Human Rights Initiative has filed the Suit No. FHC/OW/CS/102/2012 in the Federal High Court of Nigeria in the Owerri Judicial Division against the Federal Government of Nigeria and the Attorney-General of the Federation seeking to enforce the rights of indigenous people of Biafra to self-determination and independence. The said suit brought by way of originating summons requires the Federal Government of Nigeria and the Attorney-General of the Federation to appear in court to answer some questions. The matter comes up on 30th of October, 2012.
For the first time since after the Nigeria-Biafra war ended 42 years ago, Biafra adherents, determined to forge a new nation still in the name and title of Republic of Biafra with its land, littoral and continental shelves, have dragged Nigeria as represented by President Goodluck Jonathan and the Attorney General of the Federation to Owerri Federal High Court over the inalienable right of the descendants of the ancestors of Biafraland who are the remnants that were not consumed by the 1967-1970 genocidal war in which about three million Biafrans were killed, to self-determination and thus are praying the court to pronounce the territory as it was pre 1967 independent and sovereign in the light of relevant charters on Human and peoples rights, realities of the incompatibility of those who make-up the geo-space called Nigeria among others.
In a press release made available by the spokesperson of the litigating entity, BILIE Human Rights Initiative, Comrade Arinzechukwu Awogu, which was signed by the group’s Secretary General, Elder Eddy Anyanwu, the litigating entity, BILIE Human Rights Initiative, has by this legal action made good its threat to take the Nigerian government to court over Biafra’s quest for independence and other unresolved hang-over from the Nigeria-Biafra war, which included the use of starvation as “legitimate instrument of warfare,” the bombing of civilian targets, the 20 Pounds per account holder policy, the abandoned property saga, the hasty indigenization policy enacted and implemented before the recovery of war affected people of Biafra, among other vexed issues.
Comrade Arinzechukwu Awogu believes that Bilie Human Rights Initiative has commenced what would eventually lead to a peaceful and coordinated political and economic freedom for the people of Biafra. “We are using legal method in our approach. We are in court to seek legal clarity on our right to self-determination vis-a-vis our inalienable right to decide our political future under Biafra geo-space. I consider that, with this legal action, we in BILIE Human Rights Initiative have decided to fast track our legal effort to compel the Nigerian government to among other things cease arresting anybody answering to or wearing Biafran emblem, insigner or any material that reflect their believe in Biafra. This is to make it possible for law in Nigeria to give clarity on this very important issue and to prevent the Nigerian state from using intimidation and unlawful acts to suppress the agitation for Biafra.
“We need to put this thing in law, to test the validity of the claims by Nigeria. We will be asking the Nigerian government in court to tell the world if the word “Biafra” is a crime.”
The suit also sought to know whether the Defendants (Nigeria and Nigerians) were right to seize and confiscate the assets, properties, money, and all treasures belonging to the Claimants (Biafrans) by promulgating the Abandoned Properties Act of 28th September 1979 while the 1963 Constitution was in force, being more than nine years after the war and after the declaration of “One Nigeria” while regarding the Claimants (Biafrans) as Nigerian citizens but depriving them of their properties, money and assets; and if the answer is in the negative, whether the Defendants (Nigeria and Nigerians) are still justified to withhold the said money, properties and assets belonging to the Claimants (Biafrans).
It also sought the Court’s pronouncement on whether the Defendants (Nigeria and Nigerians) were justified to violate the International Humanitarian Law and the Laws of War known as the Geneva Convention 1949 (to which the Defendants acceded and ratified on 20th June 1961) by bombing the Biafran civilians, killing the Biafran civilians and using starvation to kill the children, women and the elderly of the civilian population of the indigenous people of Biafra in the war of 1967 1970 in order to win the war, as was partly reveled by Prof. Chinua Achebe in his latest book “There Was A Country.”
The suit is also asking the court whether the Defendants (Nigeria and Nigerians) by registering Nigeria as a member of the Organization of Islamic Countries (OIC) in 1986 and licensing an Islamic Sharia Bank in Nigeria under the 1999 Constitution contrary to Section 10 of the Constitution of Nigeria have violated the Constitution and turned Nigeria into an Islamic country; and if the answer is in the affirmative, whether the Claimants (Biafrans) have the right to dissociate themselves from the Defendants (Nigeria and Nigerians) and refuse to answer the citizens of an Islamic country in the exercise of their right to freedom of worship, freedom of association and self-determination as a people
The press release reads thus:
1. Introduction:
BILIE HUMAN RIGHTS INITIATIVE is a human rights organization and the only legal entity in Nigeria registered with the United Nations as an Indigenous Peoples Organization (IPO) and also as Incorporated Trustees by the Corporate Affairs Commission Abuja for the purpose of protecting, defending and advocating for the rights of indigenous people of Biafra and all other indigenous peoples and nationalities within Nigeria whose rights and freedoms are violated by the Nigerian Government contrary to the United Nations Charter on Human Rights and the African Charter on Human and Peoples Rights. The word “Bilie” means “Stand Up” or “Arise” in Igbo Language. We are calling on all Igbo speaking people in Nigeria to stand up for their rights. Bilie is a human rights group advocating for the rights of the descendants of the ancestors of Biafraland who are the remnants that were not consumed by the 1967-1970 genocidal war in which about three million Biafrans were killed. Bilie Human Rights Initiative is a national liberation movement for the purposes of international law with power to represent all indigenous people of Biafra in legal actions against any person or any Government whether in the Nigerian Courts or in the International Court of Justice in The Hague.
Gentlemen of the Press, we are here today to let the world know what is happening in Nigeria. The safety of the lives and properties of indigenous people of Biafra living in Nigeria are no longer guaranteed. The Biafrans were forced to surrender their sovereignty and become Nigerian citizens on the promise that their lives and properties would be protected by the Government of Nigeria. Now, it has become clear that the Government of Nigeria is impotent and incompetent to protect the indigenous people of Biafra who were not consumed by the war. In fact, the Nigeria Police and Army Officers have continued to harass, intimidate, arrest, detain and kill the Biafran human rights activists who are agitating for the self-determination and independence of Biafra by peaceful means but spare the militant activists from other tribes agitating for their own tribes. There is a clear policy of discrimination, marginalization, oppression and racism against the remnants of the indigenous people of Biafra living in Nigeria which has caused some of them to deny their identity in order to receive favours from the Federal Government of Nigeria. The situation has compelled Bilie Human Rights Initiative to file multiple suits against the Federal Government of Nigeria and its agents on behalf of the indigenous people of Biafra to protect their human and peoples’ rights. At the moment, the two suits we have filed are as follows:

The Case for Self-determination and Independence of Biafra: Suit No. FHC/OW/CS/102/2012

LET the Federal Government of Nigeria and the Attorney-General of the Federation within thirty days after service of this summons on them, inclusive of the day of such service, cause an appearance to be entered for them to this summons which is issued upon the application of BILIE HUMAN RIGHTS INITIATIVE representing INDIGENOUS PEOPLE OF BIAFRA who are indigenes of the South East geopolitical zone of Nigeria, parts of the South-South geopolitical zone of Nigeria and parts of the Middle Belt zone of Nigeria seeking to enforce their right to self-determination pursuant to Articles 19 – 25 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act, Cap 10 Laws of the Federation of Nigeria 1990, and to redress all wrongs occasioned on them by the Defendants in consequence whereof the Claimants pray for the determination of the following questions: 3
1. Whether the Indigenous People of Biafra who are the remnants that were not consumed in the Nigerian-Biafran war of 1967 1970 have the right of self-determination pursuant to Articles 19 25 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act, Cap 10, Laws of the Federation of Nigeria, 1990.
2. Whether the Claimants who identify themselves as Biafrans by indigenous identity are committing any offence by doing so contrary to any provisions of the Constitution of the Federal Republic of Nigeria 1999 or contrary to any provisions of the Criminal Code and whether it is a crime under any national or international law to mention the name of BIAFRA or for the remnants of the Indigenous People of Biafra who were not consumed by the war to maintain their indigenous identity as Biafrans with their native emblems and symbols as they do now even though they are Nigerians by citizenship and nationality laws; and if the answer is in the negative, whether the Defendants are justified to arrest, detain, shoot and or kill the children of the Claimants for identifying themselves as Biafrans by indigenous identity contrary to the rights of indigenous peoples as guaranteed by Articles 19 25 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act, Cap 10, Laws of the Federation of Nigeria, 1990.
3. Whether by the interpretation of Section 2 of the Constitution of the Federal Republic of Nigeria 1999 it is a crime for the Claimants and or the people of other ethnic nationalities held together in Nigeria against their will to exercise their right to self-determination by seeking for independence under the law as guaranteed by Articles 19 25 Cap 10 Laws of the Federation of Nigeria 1990 and the United Nations Resolution 61/295 of 2007 known as the United Nations Declaration on the Rights of Indigenous Peoples.
4. Whether it is lawful under the Constitution of Nigeria 1999 and under the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act Cap 10 Laws of the Federation of Nigeria 1990 for the Defendants to hold the ethnic nationalities in Nigeria together by force against their will who now constitute the six geopolitical regions namely: South East, South South, South West, North Central, North East and North West, in a forced marriage akin to slavery contrary to their human and peoples’ rights of self-determination as there is no provision in the Nigerian law or international law that makes it a crime for a people to seek for freedom by the rule of law.
5. Whether the amalgamation of the peoples of the south and north by the British Government to form one country called Nigeria was with the consent and agreement of the indigenous peoples of the lands; and if the answer is in the negative, whether the Order-in-Council 1910 1913 made by the British Government to create Nigeria in

1914 was null and void ab initio for lacking legitimacy as it could not form the basis of the Nigerian Constitution thereby rendering the amalgamation invalid.
6. Whether by the Constitution of the Federal Republic of Nigeria 1963 which took effect on 1st October 1963 and remained in force until the midnight of 30th September 1979 the Defendants were right to seize and confiscate the assets, properties, money, and all treasures belonging to the Claimants by promulgating the Abandoned Properties Act of 28th September 1979 while the 1963 Constitution was in force, being more than nine years after the war and after the declaration of “One Nigeria” while regarding the Claimants as Nigerian citizens but depriving them of their properties, money and assets; and if the answer is in the negative, whether the Defendants are still justified to withhold the said money, properties and assets belonging to the Claimants.
7. AND LET THE DEFENDANTS TAKE NOTICE that the Claimants who are called Biafrans by indigenous identity and Nigerians by nationality have commenced the legal processes leading to their referendum for self-determination and shall at the hearing of this summons pray the Honourable Court for:
(a) An Order declaring that the Claimants have the right to self-determination pursuant to Articles 19 25, Cap 10, Laws of the Federation of Nigeria, 1990, and are therefore free to exercise their right to self-determination for independence or any other political status of their choice.

(b) An Order declaring that the ethnic nationalities that make up Nigeria are not held as slaves under Section 2(1) of the Constitution of Nigeria 1999 and therefore have the right of self-determination to decide their political status by the rule of law.
(c) An Order declaring that the Defendants are liable to pay to the Claimants by way of compensation or reparation the present value of all the money, properties and assets of the Claimants seized by the Defendants as a result of the Nigerian-Biafran war of 1967 1970 since the properties were not seized in wartime but nine years after the war based on the post-war discriminatory policies and laws made by the Defendants to suppress the Claimants from generation to generation.
(d) An Order directing the Defendants to comply with the provisions of Article 20 (3) of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act Cap 10 Laws of the Federation of Nigeria 1990 and consequently give all assistance to the Claimants in the exercise of their right to self-determination for a peaceful conduct of their referendum for independence or for any other political status of their choice.
(e) An Order granting judicial protection to the Claimants, their homes, their offices and their correspondences individually and collectively as they exercise their right to self-determination and an Injunction restraining the Defendants, their agents and privies, from interfering, arresting, molesting, intimidating, disturbing, hindering or harassing the Claimants or doing any act or omitting to do any act aimed at frustrating the Claimants’ exercise of their right to self-determination which they have commenced with a referendum.
(f) An Order compelling the Defendants to release from its prisons and detention centres all indigenous people of Biafra who are agitating as pro-Biafra Movements for Independence of Biafra by peaceful means and to drop all charges of treason or treasonable felonies made against them and to release all their properties seized by the Defendants.
(g) An Order affirming the Memorandum of Ohanaeze Ndigbo dated 28th June 2012 submitted to the National Assembly for the restructuring of Nigeria into six autonomous self-governing regions, namely: South East, South West, South South, North East, North West and North Central, as a manifestation of the Will of the People in the exercise of their right to self-determination and directing the Defendants to present an Executive Bill to the National Assembly for a law granting autonomy and self-governing status to the six geopolitical regions in Nigeria; OR IN THE ALTERNATIVE, in the role of the Judiciary as the last hope of the common man, an Order directing the Defendants to present an Executive Bill to the National

Assembly for a law dissolving Nigeria in peace along the compatible ethnic groups instead of allowing the country to break up in bloodshed.
(h) An Order declaring that the Defendants by registering Nigeria as a member of the Organization of Islamic Countries (OIC) have turned Nigeria into an Islamic country contrary to Section 10 of the Constitution of Nigeria 1999 and therefore the Claimants being Christians have the right to dissociate themselves from the Defendants and refuse to be called the citizens of an Islamic country.
The facts of the case and exhibits relied on are contained in a 44-Paragraph Affidavit filed with the suit. Bilie Human Rights Initiative is by this legal action accelerating efforts to bring legal clarity to the issue of arbitrary arrests of indigenous people of Biafra. We believe that what Biafra lost after the war was its sovereignty and not its people since we were not annihilated by Nigeria as Rome annihilated Carthage. Though we lost three million souls, our God has increased our population estimated at about 50 million spread in all parts of the world. About 99% of the population of the indigenous people of Biafra are Christians holding tenaciously to their Christian faith, believing in freedom of worship, freedom of religion, freedom of association, freedom of conscience, freedom of thought and freedom of expression, and separating the State from Religion. We believe in democracy as the only system of government that guarantees our fundamental human rights. Unfortunately, the Moslems from the North who were merged with us in the country called Nigeria do not believe in democracy and do not separate their Religion from the State. They do not believe in freedom of religion, freedom of conscience, freedom of thought and freedom of expression. In a conflict between the law of the State and the law of Islam, the Moslems insist that the law of Islam must prevail while we insist that the law of the State must prevail. They regard democracy as a false religion as shown by the fliers and posters they are spreading in Britain, America, Nigeria and other countries of the world where democracy is practised. This shows fundamental irreconcilable differences in the ideologies of the two peoples. All the efforts of their ethnic militia called Boko Haram are aimed at Islamizing the whole country and forcing us to become Moslems! The Biafrans saw this Islamic virus ahead of time and sought to free themselves in 1967-1970 but the odds were too much against them since Great Britain and other developed countries of the west could not see what the Biafrans saw. In the Ahiara Declaration, General Chukwuemeka Odumegwu Ojukwu revealed that the Biafran Struggle was not only a political or military struggle but also a struggle for religious freedom. In his words, “The Biafran struggle is, on another plane, a resistance to the Arab-Muslim expansionism which has menaced and ravaged the African continent for twelve centuries. As early as the first quarter of the seventh century, the Arabs, a people from the Near-East, evolved Islam not just as a religion but as a cover for their insatiable territorial ambitions. By the tenth century they had overrun and occupied, among other places, Egypt and North Africa. Had they stopped there, we would not today be faced with the wicked and unholy collusion we are fighting against. On the contrary, they cast their hungry and envious eyes across the Sahara on to the land of the Negroes. Our Biafran ancestors remained immune from the Islamic contagion. From the middle years of the last century Christianity was established in our land. In this way we came to be a predominantly Christian people. We came to stand out as a non-Muslim island in a raging Islamic sea. Throughout the period of the ill-fated Nigerian experiment, the Muslims hoped to 7
infiltrate Biafra by peaceful means and quiet propaganda, but failed. Then the late Ahmadu Bello, the Sarduana of Sokoto tried, by political and economic blackmail and terrorism, to convert Biafrans settled in Northern Nigeria to Islam. His hope was that these Biafrans on dispersion would then carry Islam to Biafra, and by so doing give the religion political control of the area. The crises which agitated the so-called independent Nigeria from 1962 gave these aggressive proselytisers the chance to try converting us by force. It is now evident why the fanatic Arab-Muslim states like Algeria, Egypt and the Sudan have come out openly and massively to support and aid Nigeria in her present war of genocide against us. These states see militant Arabism as a powerful instrument for attaining power in the world. Biafra is one of the few African States untainted by Islam. Therefore, to militant Arabism, Biafra is a stumbling block to their plan for controlling the whole continent. This control is fast becoming manifest in the Organization of African Unity. On the question of the Middle East, the Sudanese crisis, in the war between Nigeria and Biafra, militant Arabism has succeeded in imposing its point of view through blackmail and bluster. It has threatened African leaders and governments with inciting their Muslim minorities to rebellion if the governments adopted an independent line on these questions. In this way an O.A.U that has not felt itself able to discuss the genocide in the Sudan and Biafra, an O.A.U. that has again and again advertised its ineptitude as a peace-maker, has rushed into open condemnation of Israel over the Middle East dispute. Indeed in recent times, by its performance, the O.A.U. might well be an Organization of Arab Unity.” (Ojukwu, Ahiara Declaration 1969, P. 12)
We lost our sovereignty in the war of arms and ammunitions because we could not fight with the World Powers of Great Britain, Russia, Egypt and all Arab countries that helped Nigeria to defeat us. We took the decision to surrender in order to save the remnants from annihilation knowing that it was better to fight and live to fight again. Now the fight is no longer with arms and ammunitions but with brainpower, legal wisdom and the power of the Almighty God. They defeated us in the battlefield of arms and ammunitions with the help of Britain and Russia but we shall defeat them in the legal battle of wits and intelligence with the help of our God, Chukwu Abhiama (The God of Abraham). From the time of the war up to this day, our battle song has remained the same:
“We are Biafrans, fighting for our freedom; In the name of Jesus, we shall conquer”.
Nigeria obtained only a military victory over us and could not conquer our spirits. Nigerians and their Governments treat us like a defeated people though mouthing “No Victor No Vanquished” in hypocrisy. Any person who identifies himself as an Ibo or Biafran receives persecution, hatred and rejection from Nigerians. Fair-minded Nigerians have acknowledged that the Government of Nigeria is designed to marginalize and persecute us. Alhaji Salisu Lamido Salisu, in his Conference Lecture at Arewa House in 1999, said concerning us as follows: “They have been defeated in war, rendered paupers by monetary policy fiat, their properties declared abandoned and confiscated, kept out of strategic public sector appointments and deprived of public services. The rest of the country forced them to remain in Nigeria and has continued to deny them equity. The Northern Bourgeoisie and the Yoruba Bourgeoisie have conspired to keep the Igbo out of the scheme of things. In the recent transition when the Igbo solidly supported the PDP in the hope of an Ekwueme presidency, the North and South-West treated this as a Biafra agenda. Every rule set 8
for the primaries, every gentleman’s agreement was set aside to ensure that Obasanjo, not Ekwueme emerged as the candidate… Now, with this government, the marginalization of the Igbo is more complete than ever before. The Igbos have taken all these quietly because, they reason, they brought it upon themselves. But the nation is sitting on a time-bomb”.
Yes, indeed, Nigeria is sitting on a time-bomb. Fair-minded northerners and westerners have acknowledged that the Government of Nigeria has been quite unfair to us. The maltreatments and persecutions have caused some of our people to deny their native identity in order to survive in Nigeria. Some of our people in the South-South region have changed their names to sound foreign in order to escape the persecution while some towns and villages have been forcefully assimilated into neighbouring tribes. However, as it is written in the Bible in honour of Moses, though he had an opportunity in Egypt to be treated like a Prince in Pharaoh’s Palace, he refused to be called the son of Pharaoh’s daughter but rather chose to suffer affliction with the people of God than to enjoy the pleasures of Egypt. In the same way, we who have not denied our identity as Ibos and Biafrans have rather chosen to suffer affliction with the covenant people of God than to enjoy the pleasures and riches of Nigerian politics! Our spirits are still alive despite all the persecutions we suffer in Nigeria. This is why we are insisting on regaining our freedom because we still believe in our indigenous identity as Biafrans. As Christians, we believe that we have fulfilled the scriptures and prophecies concerning us: “We are troubled on every side yet not distressed; we are perplexed but not in despair; persecuted but not forsaken; cast down but not destroyed” (2 Cor. 4: 8). Yes, we were cast down but not destroyed; persecuted by our neighbours and by the Nigerian Government but not forsaken by our God. We believe that the dry bones shall rise again and the glory of our latter house shall be greater than that of the former. We want the Court to determine whether it is an offence for the remnants of the ancestors of Biafraland who were not consumed by the war to maintain their indigenous identity as a people and exercise their right to self-determination. We want the Court to determine whether it is an offence to mention the name of BIAFRA and believe in Biafra and preach Biafranism as a gospel of national liberation. We are fast-tracking legal efforts to compel the Nigerian Government to stop arresting anybody answering to or wearing Biafran emblem, insignia or any material that reflects their belief in Biafra. We believe that this a test case for the development of human rights law, not only for the benefit of the Nigerian legal system but also for the benefit of other countries of the world who are bound by the United Nations Charter on Human Rights.
Concerning our people who have denied their ancestral identity as Biafrans and Ibos in order to survive in Nigeria, we do not hold the denial against them as we see it as a self-preservation technique which is often caused by fear and lack of boldness. We remember the biblical example of the Apostle Peter who denied his Lord and Master Jesus Christ when his life was in danger. But as Peter repented and wept for denying his identity as a disciple of Christ, we advise our brethren who have denied their Igbo and Biafran identity to repent and return to their ancestral roots because our God, Chukwu Abhiama, has come to deliver us.
Gentlemen of the Press, we cannot comment on the merits of the case now since it is before the court but we enjoin you to follow the proceedings and give it a wide publicity in the interest of the public for the advancement of human rights law. The case file has been sent to the Chief 9
Judge who will assign it to a court for hearing. The hearing date will be communicated to the Press in due course.
The Case for Eastern Pilot Newspaper against the violation of our freedom of expression:

Bilie Human Rights Initiative is registered under the laws of the Federal Republic of Nigeria with the following aims and objectives:
(a) To promote human rights advocacy and protection of indigenous peoples rights;
(b) To organize public lectures and seminars on human rights and advocate for justice, fairness and the rule of law;
(c) To uphold, promote, preach and teach obedience to the rule of law and compliance with the provisions of the United Nations Charter on Human Rights and the African Charter on Human and Peoples’ Rights;
(d) To promote good leadership, people-oriented governance and public accountability through lectures and seminars;
(e) To grant legal aids and defend all oppressed people whose fundamental freedoms and human rights are violated;
(f) To facilitate economic development, technological development and poverty eradication through research works and the promotion of qualitative education and impartation of vocational skills to the unemployed.
(g) To promote peace, security, domestic stability, respect for human rights, sustainable development, people-oriented policies, and an overall commitment to the improvement of the society and peaceful co-existence of all peoples through Seminars and Workshops.
Pursuant to the aims and objectives for which Bilie Human Rights Initiative was registered, we acquired a media outfit known as Eastern Pilot to disseminate information and educate the public on their human rights. But the Nigeria Policemen of the SSS (State Security Services) have constantly seized and confiscated our Eastern Pilot Newspapers and have continued to harass and intimidate the vendors. Their aim is to silence and muzzle us for reporting the atrocities being committed on our people by Boko Haram. Most importantly, they do not want us to educate the remnants of the indigenous people of Biafra on their right to existence as a people who were not consumed by the war. 10
The cycle of intimidation, harassments and random arrest of people who are exercising their fundamental rights to freedom of expression, freedom of thought and freedom of conscience as happened in the military era has once again stared us in the face, illuminating the sordid existence of tyranny and barbarism in the conduct and operations of the leaders of the Nigerian State. We maintain that if they find anything offensive or libelous in our publications, they have the right to bring action in court against us. But instead of taking us to court, they descend to an uncivilized method of governance by seizing our publications from vendors in the streets! The Constitution of the Federal Republic of Nigeria guarantees our rights to freedom of expression, freedom of assembly, freedom of association, freedom of thought, freedom of conscience, freedom of religion and freedom to impart our ideas to others. In fact, Section 39(1)(2) of the Constitution puts it clearly as follows: “(1) Every person shall be entitled to freedom of expression, including freedom to hold opinions and to receive and impart ideas and information without interference. (2) Without prejudice to the generality of subsection (1) of this section, every person shall be entitled to own, establish and operate any medium for the dissemination of information, ideas and opinions”. It beats our imagination that the State Security Services (SSS) who should be neck-deep in tackling and unmasking the faces behind Boko-Haram and confronting the criminals engaged in the cases of kidnapping, oil theft, social, religious and political disorders are busy swooping, raiding and ransacking newspaper stands in search of Eastern Pilot Newspapers whose only “crime” is that it is educating the masses and advocating for the rights of the indigenous peoples, making constructive criticisms where necessary on government policies in order to help in eradicating Nigeria’s chronic under-development, terrorism, sectarian killings, violence, crimes against humanity, corruption, grinding poverty, hunger, disease, illiteracy and stupefying hopelessness. The uncivilized actions of the Nigeria Police in repressing peoples’ opinions and fundamental human rights are an embarrassment to the country called Nigeria in the eyes of the international community.
The Nigeria Police of the State Security Services (SSS) on Thursday, 26th July 2012 swooped on newspaper agents and vendors in Awka, Anambra State, and arrested nine of them for selling and distributing copies of Eastern Pilot newspapers and compelled them to sign an obnoxious undertaking not to sell or distribute Eastern Pilot newspapers again. We assert that the said undertaking signed by the vendors is null and void ab initio because it was obtained under duress. Surprisingly, before this incident, the publisher of Eastern Pilot, Comrade Arinze Awogu, received series of telephone calls by some people claiming to be members of Boko Haram, threatening his life and demanding that he should stop reporting the activities of Boko Haram in the Eastern Pilot. Comrade Awogu disclosed that the GSM line which the callers who threatened his life used was 08178728792.
On Wednesday, 5th September, barely a month after the attack in Awka, the State Security Services (SSS) operatives numbering about seven, swung into an inglorious action again, seizing, parking and stuffing thousands of copies of Eastern Pilot Newspapers of Vol. 10 No. 167 Edition into their vehicle. This took place at Wuse Market Abuja in the Federal Capital Territory, in the full glare of members of the public who, irked by the absurdity and bizarre actions of the SSS operatives, resisted their attempt to arrest one of the newspaper vendors selling Eastern Pilot newspapers. The resistance of members of the public made the Police to refrain from arresting the 11
vendor. It gladdens our heart to observe that some members of the public are beginning to assert their fundamental human rights in the face of the Nigeria Police.
Bilie Human Rights Initiative sees the actions of the Nigeria Police in seizing and confiscating the Eastern Pilot Newspapers as a violation of the human rights guaranteed by the Constitution of the Federal Republic of Nigeria and therefore has filed the Suit No. FHC/ABJ/574/2012 in the Federal High Court Abuja against the Police and the Attorney-General of the Federation. We have today instituted this legal action against the State Security Services and the Attorney-General of the Federation in order to end the crazy and perverse cycle of intimidation of law-abiding citizens and harassment of innocent people who are freely expressing their views and carrying out their legitimate trade of selling Newspapers to make a living. By this legal action we wish to place it on record that any attempt to intimidate, harass, muzzle or undermine free speech and freedom of expression in Nigeria will be resisted both locally in Nigeria and internationally by all human rights activists in the world. If this violation of human rights continues, Bilie Human Rights Initiative, being a civil society organization under the United Nations, shall make an Official Report to the United Nations regarding the human rights abuses in Nigeria.
We are in Court to ask Nigerian Government and its agents why they are arresting people who are selling Newspapers carrying stories on Biafra. We are asking the Court to decide whether the word “Biafra” is a crime. We are asking whether it is an offence for a people to seek for independence by the rule of law. We are asking whether the remnants of the indigenous people of Biafra who were not consumed by the war have no right to uphold their native identity as Biafrans even though they are still Nigerians by nationality until they gain independence. This is a fundamental question that must be answered by a competent court of law and not left to law enforcement agents to interpret as they deem fit.

Remember that, that liberating the Israelites from the land of Egypt did not prevent many from suffering and dieing in the journey to the promised land. God has already blessed and rewarded those who died for His sake. The Christian victims who died in the course of woshipping God have His favour. It may have a religion coloration. It does not call for the balkanisation of the country along the speculated line.
