A 22-year-old man, Julius Aboy was yesterday sentenced to death for stealing N955, 600 by a Delta State High Court sitting in Warri. The trial judge, Justice Marshal Mukoro of High Court 1, who handed down the sentence told the convict that he is to die by hanging.

The convict was arraigned on a two-count charge of conspiracy to commit armed robbery and armed robbery, offences punishable under Sections 6(b) and 1(2)(a) respectively of the Robbery and Firearms (Special Provisions) Act Cap. RII Volume 14, Laws of the Federation of Nigeria, 2004.

In the first count, Julius Aboy and others now at large were reported to have on or about the 4th day of March, 2011 in Warri, conspired with others now at large to commit armed robbery.

In the second count, Julius Aboy and others now at large were also reported to have, on or about the 4th day of March, 2011 in Warri, robbed one Godwin Gwuene of N955, 600, while armed with a gun. The money was said to be Ususu contribution (savings), belonging to workers, serving as cleaners in a company in Warri.

The armed robbery gang, of which Aboy was allegedly a member, ran out of luck when an oncoming vehicle knocked down their getaway motorbike at the scene of the crime, leading to the arrest of the convict and killing of another member of the gang by an angry mob.

Justice Mukoro said the excuse of poverty, which the convict gave as reason of dropping out of school and venturing into crime was not tenable, as poverty was not a licence for criminality.

  1. For the reason that he used arms to disposed a defenseless citizen and his group made away the said amount he is liable to die . But then , the government of Delta state must expedite the process of his hanging without delay. Any human right groups clamouring for stay of execution should be ignored .
    These elements in the society must be eradicated by all legal process in the country.

    • That young boy should be sent to prison for reformation. If Justice Marshal is looking people to hang, he should go and engage the bigger thieves that have stolen the future of many Nigerians. This is injustice in the house of justice. While people who steal billions are celebrated, people who still peanuts are to die by hanging. Its a big shame to Nigerian legal system/constitution or its interpretation. @Owerri, bigger thieves(money launderers) use more than arms, yet the go scoot free.

  2. This judgement sounds ungrounded and stupid, a show of power by the judge. If most people in the corridors of power in Nigeria including this so called judge should ground a whole nation to an economic stand still and subject the entire populace to abject poverty without passing one day in prison, how does he think he’s justified condemning someone to death by hanging, who confessed that poverty made him drop out from sch. (as if that doesn’t happen in a country like Nigeria) and or forced him into robbery? I didn’t even read here that the boy killed anyone. The atrocities this judge and his bribe ridden friends in offices comit, surely cause the death of Nigerians in 100s and 1000s and yet no judgement is passed on them. I think a death penalt is extreme in this case, non justifiable and should be protested against. Thanks

  15. Mr. Judge you are wicked and cruel in your judgement, perhaps because he is poor and could not bribe you. You and your learned colleagues who look at ranks before giving your judgements will one day fall by same fate. I hate armed robbery because, they kill or maim people in the course of it, but what about the government officials who have stolen and sent many to early graves. Have they not killed? How many have you jailed or even sentenced to death?
    All you evil judges will get your rewards from the ultimate JUDGE one day. What about life imprisonment?

KILLING THE ARMED RUBBER SHOULD NOT BE THE OBJECTIVE HERE RATHER MAKING HIM FEEL SORRY FOR HIS ACT SHOULD BE THE OBJECTIVE.   20. Capital punishment of any kind for a robber who did not kill is cruel and unusual punishment . Twenty-one years or more in the house of correction rather than capital punishment would have been a proper sentence. This judge certainly over reached by applying Gowon’s degree which failed to stop armed robbery in the immediate post war and should be obsolete today in our democracy.
    Society benefits more when justice leads an impressionable youth to a place of correction and restoration rather a death camp.
    The judge also erred when he denied the possibility of poverty leading to criminality. You can see the problem of studying law without a prior liberal arts background.

As a Nigerian who knows where the judge is coming from I can say that the Judge cannot be seen as a cruel and stupid,Because that is the reality of what is on the ground…Nigeria Law forbids gun possession to a certain extend….so many Nigerians have not shot a gun,talk-less of seeing it with their naked eye.So when you rob people with gun,you not only rob them their possession you also rob them of their sense of security ,if they have any.Also the brutal nature of armed robbers in Nigeria makes any judge to be harsh on anyone that is convicted.
    Having said this …I don’t think Capital punishment solves any problem ,it rather creates more,because if an armed robber know that you will kill him if he take only money and leave,he will not only take your money he will kill you as well,and who loose at this point…Also Nigeria justice system is not transparent,how do we know that this is the guy that robbed with a gun….even in United States,there have been cases where they convicted a wrong person.So I will never support Capital punishment for it is not the best way to go.

  22. @ Dozie. If you had read the story well, you would see the young man was caught at the scene while his colleague was lynched. Some people here are calling the judge a wicked man. They fail to realise that the judge is handicapped by the law. Our law states that if an armed robber is found guilty, death is the sentence. So even if the judge loves this boy, he cannot do otherwise or else he will answer to superior authority. Note that all judgements passed are sent up to the Law council for review and publication. If we feel that death is too harsh for armed robbery, we should press for a review of the law but for now that is the case. Even the armed robbers know that.
