Jonathan wades into Orient Oil crisis

President Goodluck Jonathan has waded into the crisis which led to two communities in Anambra and Kogi states laying claim to Orient Oil. He commissioned the facility in August this year. Since the commissioning of the first oil refinery built by Orient Petroleum at Aguleri Otu in Anambra East Local Government Area which makes Anambra, an oil producing state, some of her neighbours, including Kogi and Enugu states have been claiming ownership of the well.

The President after meeting with Gov. Peter Obi of Anambra and his Kogi counterpart, Idris Wada, is said to have directed the National Boundary Commission to expedite action and ensure all the matters are resolved early enough to forestall any violence. Speaking to State House correspondents after the meeting, Wada said, “the President has given the necessary directives. We are very happy with the meeting, we are going back very happy to tell our people that Mr. President is handling this matter in an expeditious manner according to laid down procedures and at the end of the day, the matter will be resolved amicably”.

Obi said: “The outcome of the meeting is very amicable. The issues regarding to areas where the oil wells are located will be settled amicably. We will work together as states of this federation”. Wada had in an official statement, said that “Kogi will be a major stakeholder in the refinery, considering the fact that the oil wells that will supply crude to the refinery are in Odeke community in Ibaji Local Government Area of the state.”

The governor was backed by a group called Ibaji Development Association (IDA) which says that oil wells OPL 915 and 916 are located in Kogi, not Anambra State, as claimed by Orient Petroleum which is carrying out exploration in the area. In a message to President Jonathan, the ID had said: “The area where the current productive oil well is located is in Odeke community in Ibaji Local Government Area of Kogi State and not in Anambra state.

“Oil exploration activities leading to the successful access to crude oil were carried out in Kogi State within Odeke, Echeno, Ehile, Anocha and Omabo communities by Orient Petroleum Plc. Workers of this company actually rented houses in these communities as quarters for the final phase 1 of the testing of these wells”, the group had said.

They called on President Jonathan then to officially declare Kogi, an oil producing state, saying, “our non-resistant stance should not be misconstrued to mean cowardice, even in the face of glaring provocation from Anambra State whose communities are already head over heels fighting to corner the benefits of the oil wells that do not belong to them.” But in a broadcast to the people, Gov. Obi had expressed shock over the claims on the oil field discovered in his domain.

Tracing the formation of Orient by Anambra and the efforts of his state so far, he said: “It is pertinent to recall that Orient Petroleum Resources Plc was formed during the Government of Dr. Chinwoke Mbadinuju in 2001 and allocated oil fields domiciled in Anambra State. “The board is peopled by prominent Nigerians of Anambra extraction such as Chief Emeka Anyaoku (Chairman), Dr. Alex Ekwueme (Vice-Chairman) and Chief Arthur Mbanefo, among others.

Its management is led by Engr. Emeka Nwawka, “Though Dr. Mbadinuju did not make any direct monetary contribution, under Dr. Chris Ngige (2003-2006), Anambra State Government invested the sum of N100 million naira in the project. “Under our government (between 2006-2009), Anambra State, with the vision and belief in the positive impact of the project on the economy of the state and country, invested, directly and indirectly, the sum of N4.4 billion, which bolstered the confidence of other investors to invest in the venture that made its commissioning a reality.

“Whilst my predecessors never visited the site, I personally laid the foundation of the refinery. I have also visited the site severally since 2006, without any group or state interfering in its ownership as is now the case following the announcement of drilling of oil there. “It is also pertinent to note that till date, neither the group nor the states laying claim to the oil field have, directly or indirectly, invested a kobo in the project, while Anambra State and her people have invested several billions.

“Let me at this juncture state that Anambra State believes in good neighbourliness and will, in conformity with our nature, always admire and celebrate other states which may become producers of oil or any other mineral resource in the future. However, we believe that people’s hard work, sacrifices and investment should be allowed to match their opportunities. Anambra State will remain a good neighbour and will continue to pray for oil to be discovered in other states so that Nigeria will emerge an economic giant in the comity of nations in the world,” Obi concluded.

The scenerio is a replica of what happened between Akwa Ibom and neighbouring Cross River states since the latter lost ownership of 76 oil wells to the former in a major Supreme Court decision in July. Reports from the National Boundary Commission showed that the boundary between Anambra and Kogi states was last delineated in 1924 , during the colonial era.

Mr. president has mandated NBC to clearify on this issue. Why not let the commission do its work? Why resorting to the use of vulgar language on the gov & the people of the state?     Kogi state and enugu state , how do you just wake up from sleep and start claiming something in anambra state . are too lazy to develop your resourses?
    It is more honourable to beg than to start laying claims to what you don’t have .go and develop stone and iron refinary or coal refinary ,or has anambra state had to stuggle with you on these resourses.
    If you are jelous go on your knees & beg instead of frivolous claim that you know your’re going to loose.

    I cannot just understand the type of stupid and childish noise Nigerian states make regarding mined commodities like petroleum and related underground natural resources. Let’s suppose for a moment that the present oil wells are actually located in Kogi State and, possibly, Enugu State, what stops the three states from sitting down together as neighbours and agree on the modality for sharing this resource? Anambra has already invested a lot of money into this venture and there is no way the other two states can just rout Anambra from the scene; it would be stupid and foolhardy. In legal terms Kogi and Enugu States should remember the principle of adverse possession as it affects land. Enugu and Kogi cannot claim ignorance of what Anambra had been doing all these long years on a land Enugu and Kogi felt belonged to them. In law Enugu and Kogi should have come out immediately to establish their right of claim to that land. But since they did not do this, the law stipulates that a ‘squatter’, that is Anambra State, has taken possession of that land and so is entitled to having legal certificate of occupancy from the Federal Land Registry. That is the law.

    That is the legal way of settling that dispute. But I know people might scream at that. However, it is always advisable to settle matters out-of-court. Courts usually advocate and encourage this. Therefore the more pleasant route would be for the three States to sit and determine how they would share the resources; and nothing is wrong also in calling Enugu and Kogi States, ‘oil-producing states’ if that is what they want; if that is what would make them happy. I don’t advocate a ‘winner-takes-all’ in this matter. I say this because I foresee that the National Boundary Commission will definitely come up with a verdict that would not be pleasant to one of the contestants in this case. But an all-encompassing solution, as I have mentioned above, is to co-opt every contestant into the petroleum and refinery scene, thus making everybody happy at the end of the day.

    i sincerely don’t support majority of the comments here. if the land that the oil is discovered is in kogi state, what is wrong in kogi state claiming ownership. that you own a land and another man builds a house there does not make you lose ownership of the land. Are we saying that if the oil was actually found in Aguleri or Anam and the president now declares Kogi the owner that Anambra state will fold their hands or be hailing Mr. president for a job well done. To me i see orient petroleum as an investor and kogi state did not say that orient petroleum should not invest in their state. I strongly believe that if the national boundary commission will do their job diligently without fear or favour that the actual owners will very soon emerge. The truth of the matter is there are lots of oil deposits in Kogi, Anambra and Enugu state, the president should as a matter of urgency declare these 3 states oil producing states.

    GOOD for Anambra to have built the Refinery but the State should tap her oil within her boundary to feed her refinery. It amazes one to read from an Anambra Professor talking about witchcraft in a matter that is purely scientific and provable. That is why in African magic the Igbos showcase only witchcraft, killing of brothers over land. DO NOT DARE THE IBAJIS AND THE IGALAS because you won’t see them to fight them.     This is crazy, you meant the Government and people of Anambra did not know that the land they build on was not theirs or what? I dont think the idea is good, if that land belongs to Kogi as claimed there must be an agreement between the 2 or 3 states, since there was no agreement it simple meant that the 2 other states wanted to show wickedness. I am not from the both states but I like calling a spade a spade. Pls let them tell us the truth because Anambra cannot spend this much money and others will come up and be major shareholders, it is not done that way. Pls for those of us raising angers of how they will crush others should know that we are one and with peace we can still be one.

    I can’t say anything about Kogi people because I don’t know how they border Anambra state but for Enugu state we shouldn’t be in a haste to forget that Anambra and Enugu use to one state and most part of Ayamelum local govt in Anambra was carved out Uzor Uwani local govt of Enugu state and remember you may have built refinery in Aguleri but the oil wells or some of the oil wells in question might be located beyond Anambra border so you don’t just expect Enugu state to just fold their arms and nod their heads in affirmation, we must come to the round table and fix it, after all not too long ago Coal had been the major sources of Income,Electric and locomotive power,livelyhood to the Nation,I believe Enugu and Anambra can always settle their issues amicably as sister states

    Reason and facts have to prevail on issues like this, rather than making careless statements. Nobody has told us clearly the position of Boundary Commission on the matter. If actually some of the wells are located in Kogi State, is not possible for the two states to reach an understanding to explore these reources for the benefit of the two states, Nigeria, and the world. If Shell can come from Denmark to explore oil in Nigeria, while is it not possible for Anambra State to explore oil in any part of Nigeria, provided they comply with the Laws of land. Kogi and Anambra please sit down and discuss. Your God given resources and the infrastructure already in place to explore it might be of benefit to your people. Be wise, and ignore the silly comments made by some ignorant people here.

Even the ordinary man in Akwaibon state knows that what the 76 oil well de decemated to them belongs to cross river state. Where were the committee when nig lost bakassi to cameroon?
