Eze Ilomuanya: Court slams N10m damages against Imo govt


A Federal High Court sitting in Owerri, Imo State, has awarded N10 million as damages to a south eastern monarch against the state government over unlawful invasion of his residence. Chairman of South East Council of Traditional Rulers, HRH Eze (Dr.) Cletus Ilomuanya had filed a suit against the state government over the invasion of his Owerri residence and forceful removal of three of his vehicles on August 5, 2011.

It is, however, expected that the state government through its attorney-general would appeal the judgment. Other respondents in the suit include the state governor, the state attorney-general, the state commissioner of police, the inspector-general of police, the Police Service Commission (PSC) along with Dr. Placid Ekwueme, Peter Onu, High Chief Uche Njoku, Chief Ugochukwu Nnawuihe, Hyginus Nwosu and Larry Ajero (for themselves and as members of Imo State Government of Nigeria State Committee on Recovery of Government Properties). Delivering judgment in the suit, Justice F. A. Olubanjo ordered the respondents to pay the claimant N10 million as compensation.

Olubanjo described the invasion as “barbaric and unlawful” adding that it “amounts to a gross violation of Ilomuanya’s fundamental rights guaranteed under Sections 46, 37 and 44 of the 1999 Constitution and Articles 7 and 14 of the African Charter on Human and People’s Rights (Ratification and Enforcement Act).” The court restrained the respondents by themselves and their agents from entering the aforesaid Eze’s property and or any other of his property.

It also made an order of perpetual injunction restraining them from harassing, threatening, hounding or intimidating him or violating his rights in any manner. It held that there was no justification for unlawfully raiding the monarch’s house with armed policemen and thugs. In a statement by the South East Council of Traditional Rulers through the chairman’s Chief Press Secretary, Kennedy Eweama, the council stated that the claimant’s counsel, Obiora Obianwu (SAN) described the judgment as a victory for decency and rule of law.

It added that Obianwu said every citizen was subject to the law. However, the state government has expressed reservations with the judgment and has perfected plans to appeal the judgment especially as it believes the action was legal and carried out within the ambits of the law.

Ilomuanya’s house should be searched very well because i believe something shocking will be discovered from it from the timeof the Otokoto’s. All the car gift to him by his fellow 419n Ohakim should be recovered from him period! Imo must move forward.

    Ilomuanya was Ohakim,s man during the time they are looting Imo-state. With that Ohakim rewarded a know criminal with the chairman Imo-state council of traditional rulers with some man gifts of cars and property attached to it. So it is not surprising that Okorocha will go after him to recover those car gifts which rightly belong to Imo-State.
    Every Orlu man knows how he got his Obi of Ihitiowerre. The same way the late joneb got his Obi of Awkuzu.
    This judgement cannot stand. I knew the state government must have ignored him and used the opportunity to trick the Judge but I am sure it will not stand on appeal.

    The problem Owelle Rochas Okorocha have been facing since his assumption of office as a governor of Imo state are no any other persons than Achike Udenwa and Ikedi Ohakiha.I am sorry they can do nothing to Rochas since he is more reasonable than the two big fools that ruled Imo state for 12 yrs without anything to show for it. Rochas, i will advice you not to mind their distractions here and there, go ahead with your planned visions for Imo state so that Imolites will judge their 12 yrs and your tenure to compare and contrast at the end of your regime. It is nothing but gang up to distract you not to perform like them. People like me will only listen to the idiots when we found out that you are not doing any tangible projects in Imo. Ever before you came in as a governor, Nigerians have benefited from your kind gesture through your free education and so many things you have helped the less privilaged ones all over the Federation, East, West,North and South. Any means or an individual they may used to disturb your good work in Imo State, deal with them rudelessly through legal process.

    Owelle and his confused govt.can proceed for appeal and afterwards supreme court will be the final stop. The L.G.A chaimen and councillors,court upturned owelle’s decision,it now remains their tenure determination.2. The 10,000 workers have defeated him twice at the industrial court Enugu,he has filed an appeal which is also bound to be defeated.3. Ararume vs INEC of which owelle’s govt is indirectly inclusive as we all know that what happened on may 5th is an illegality. 4. The current case won at the state’s high court. Even if Ohakim “installed” Eze ilomuanya,must you use force to eject him? Why can’t you use a democratic means to that effect. This is no military regime,neither are we practising a monarchy system of govt. As all the force owelle is using,is now boomeranging on him. Only time will tell!

    The issue here to be determined is forceful and unlawful entering of Eze Ilomuanaya’s compound in Owerri by the task force on recovery of government properties. Yes they did invaded the compound to recover government cars in poccession of Ilomuanya when he failed to surrender those cars to the government when he knew that he was no longer the state’s chairman of Ndi-eze. As two wrongs can’t make a right,Ilomuanya was wrong to withhold those cars but the task force should have been civil in their approache to the recovery since we are practicing democracy. They should have approached the court instead of taking the laws into their hands. But during the said invasion, the press were awash that order came from Abuja that stopped the operation so the question to be asked and answered now are these,1, are those cars still under the poccession of Eze Ilomuanya? Now that the high court has ruled that Ilomuanya should be paid 10 million naira as damages what happens to those cars since it was obvious that those cars were not removed by the state’s task force? Is Eze Ilomuanya above the law that he refused to heed the calls and appeals from the state’s government to surrender all properties in the custody of all public appointees that served under Ohakim but no longer relevant in the new Rochas’ administration? Its better for the state govt to proceed to appeal court for there is merrit in the case. There is miscarriage of justice in this judgement.

I can’t resort to insulting anybody on this platform,cos it will amount to childish attitude on my side…all i can say that if you have a superior/counter argument than what i have stated above why waste time,bring it up. Owelle got to know that victory for all those(Eze ilomuanya,10,000 youth workers,L.G.A chairmen and councillors,land lords and clergy men-he demolished their properties without compensation… etc) he stampeded upon is sure no matter how long it takes.Even his “beloved” children(the Imo state tertiary students-NAISS) are threatening to sue him for deciet. hahahahahahaha…i repeat, Only time will tell!

    Rogers seems to be doing well in the state in tems of development but he is overstepping his limits on certain issues.

    He should try and do things that will give him plus and not minus. He should not be runing the state as a personal enterprises or a family business.

    He cannot continue to claim monopoly of wisdom with disregard to the rule of law.
