Ojukwu Transport Company sues Bianca

•Demands  N140m from Ikemba’s widow over Lagos property

Ojukwu Transport Company has sued Mrs. Bianca Ojukwu, widow of the Ikemba, Chukuemeka Odumegwu-Ojukwu, before a Lagos High Court over a property. The firm, which is represented by one of its directors, Dr. Ike Ojukwu, filed the N140 million suit before Justice Adedayo Oyebanji. It is demanding payment of N40 million being the expected rentable value per year of the said premises from September 27, 2012 until the defendant gives up possession of the property.

It is also seeking N100 million in compensation for damages. In its statement of claim, the company alleged that its property at 29, Oyinkan Abayomi Drive (formerly Queens Drive) Ikoyi, Lagos is being illegally “detained” by Bianca.

The property is said to comprise of two-storey detached house. During proceedings yesterday, counsel to the claimant, Mr George Uweche (SAN), told the court that the defendant (Bianca) was served with court processes but had not filed a defence against the suit neither was she represented in court. The company, in its statement of claim, said that by a power of attorney dated May 4, 2012, it appointed one Massey Udegbe of Massey Udegbe & Co as its agent to manage the property in dispute.

It noted that the said property was earlier occupied by one of its directors, Chukwuemeka Ojukwu, who had since relocated to Enugu State over 10 years ago. The plaintiff stated that the said property was left in a dilapidated and unsafe condition before it was handed over to Massey Udegbe & Co.

The claimant said that by a letter dated July 19, 2012 marked MUC/MAN.OTL/222, the managing agent informed Bianca of his appointment and requested her to hand over physical possession of the property, but she allegedly refused. The company argued that it published public notices in some newspapers to ensure that the general public is aware of its appointment of Massey Udegbe & Co as the managing agent.

The claimant said that its solicitor also filed a notice of owner’s intention to recover possession of the property yet, Bianca has allegedly refused to release the property, noting that the defendant’s continued illegal detention of the property is seriously affecting the operation of its business. In a sister suit marked LD/1681/2012, filed against occupiers of a property situated at 13 Ojora Road, Ikoyi (formerly Hawksworth Road), the claimant (Ojukwu Transport Limited), is also asking for another N40 million from some unknown persons being expected yearly rentable value of the said premises from September 27, 2012 until they give up possession of the property. The claimant, also asking for N100 million as damages. Hearing in both suits has been fixed for March 25, 2012 for hearing.

      The property in contention does not belong to Odumegwu Ojukwu but to his father, so the property belongs to the OTC

    One does not give what he does not have. Chukwuemeka Odimegwu Ojukwu can not will to Bianca Ojukwu transport company because it is not his sole property but jointly owned by the family. Both law and traditions accepts this.

      Where were all these fouls that are making noises now when Odumegwu was alive? Remember Bianca did not come from a cheap family that yuou guys can trample upon. Go and build your own Ikoyi house and let the woman and children be. A woman is nothing before all igbo men. That is not the culture we welcome in this techo age. Bianca is entitled to her husbands properties, and will pass these same properties to her children. You guys can go to Okija and Ijebu, but you will not succeed. I don’t think Odumegwu was daft in usurping family properties to himself alone. You know the truth but want to hide under that age old custom of depriving a woman her husband’s properties. You guys are in for a good fight with Bianca. By the way, yuou will loose.

    Wether the property belongs to them all collectively or otherwise, is not the issue as far as I’m concerned. The question for these so called men is, where were there when Ikemba was alive? and what efforts did they put up to claim their rights of inheritance then?

    All of u are comentin on issue u don’t know, as nnewi man, am in a better possition to know, otc & co belong to ojukwu father who is also a polygamous, and ojukwu is not the first born or from the first wife, but most prosperious son, the family are managing the company in harmony until civil war, after the war the goverment confiscated all their company, so when ojukwu return from exile he started struglin to recover the company, he met his brothers to discuss it with them, they say bcs of him it was confiscated so let him retrieve it, so they started havin problem, igwe rule that ojukwu go for it bcs his the only one that has the connection, at long last ojukwu recover it, and since then ojukwu told his brothers that he have the lion share due to he use resourcess in recoverin them, so there is dispute, so when ojukwu wrote his will he did’nt include otc , so the property binca is holdin is the one ojukwu claim by himself as the lion share, so that is why his brothers refuse, in ojukwu will he indcated that all his share in otc company will go to bianca and his children, so when they share it properly bianca will take his lot.

    Lets be serious here, Ike Ojukwu sued Bianca while hiding under OTL. Ike you are a bastard and should concentrate more on your practice. Ojukwu simply willed theproperties belonging to him to his most immediate family and Ike wanted to wrestle that from Bianca. Sorry. you will never succeed.
