Capital Oil/Access bank crisis: Ubah files contempt suit

Legal crisis between Capital Oil and Access Bank Plc, deepened last Friday as a businessman, Ifeanyi Ubah and his firm took a fresh step to convict the bank for alleged contempt. In form 48 filed against the bank, Ubah alleged that Access Bank and some of its principal officers failed to comply with an order of a Federal High Court at the High Court of Justice, Queen’s Bench division, Commercial Court, London, ordering the bank to withdraw the suit filed against him relating to the dispute between them over a purported loan.

They alleged that rather than withdraw the London suit as ordered on January 28 by Justice Okon Abang of the Federal High Court, Lagos, the bank allegedly went before the foreign court on January 31 and got a fresh order directing them, Ubah and his company to among others, take steps to vacate all orders made by the Nigerian court. Justice Abang had on January 28 ordered Access Bank to discontinue the London suit within 48 hours and exhibit a notice of discontinuance at the next hearing date.

The judge, in a ruling, faulted the bank’s decision to secure an order from a London Court despite a subsisting order of his court barring Access Bank and others from interfering with the property and business interests of Capital Oil and Gas Limited pending the determination of a suit by Ubah and his company. The judge upheld argument by lawyer to Ubah, Wole Olanipekun (SAN) that, by heading for London over a dispute in relation to a transaction that took place in Nigeria, the bank had “ridiculed the Nigerian judiciary.” Justice Abang restrained the bank from enforcing the order made by the London Court against the assets and business interests of Capital Oil.

      What do you mean by embarrassment?.Nigeria don’t have any form of judiciary.If Uba has no skeleton in his capboard,he should go to London and answer them.After all he is doing international business.I don’t know why GEJ don’t want to reform our judiciary and law.

Two Days back, A Nigeria was killed by India police and dumped in Train Station in Mumbai City India and Nigeria Embassy in New Delhi India is doing nothing about that….. Police always visit Nigerians in their house harassing them and making away with the valued properties and cash with a note that they will kill them if they talk and Nigeria Government will not do anything or come for their Help……………In 2008 during the Terrorist Attack in Three 7 Star Hotels and Railway Station in Mumbai city India…..It was flash on TV as a Breaking News that Nigerian Drug Dealer are shooting guns in Mumbai and after they noticed that it was a terrorist attack by Pakistan Terrorist and Nigeria Government and our Embassy did not do anything about it……. Two weeks ago a group of Police went to all Nigerians houses living in Kalina, Mumbai City India and carry more then 28 people to Police Station and after release them with the help of other Nigerians as we stationed ourselves in police station and the police people make it clearly that they did not found anything in those Nigeria guys houses….. But it was a surprise to read on News Paper the following day that 38 Nigerians was arrested with drug and charge to court and we reported the matter to our Embassy, but they did not do anything about the allegation and bad name leveled against Nigeria and her Citizens in India…………………. Two days ago, A Group of police man told 5 Nigerians that they did not want to see Nigerians or Black people in India again and their citizen and police will continue to kill Nigerians here in India until we leave their country and Nigeria Government will not do anything to them……. … India People have refused to give Nigerians a house to live because their police warn them not to give house to Nigerians and they always send our people packing out of their house within 24 hours without thinking of where the person would take his property to or spend a night because they don’t give our people time or days to get another place to live or take their property to…………………………… Meanwhile, Thousand of Indians are living in Nigeria Comfortably and Nigeria people and some Landlord are serving and respecting them and renting a good house out to them…… but here they refuse to give Nigerians a house, shop or even allow them to have freedom to walk around here in India and do their businesses……India Police have close all Nigeria Restaurant and Shops In Mumbai City and asking them to leave India and go back to Nigeria………… India Citizens always beat Nigerians on the road calling them all kind of names and whenever Nigeria report the matter to police, The police will tell the Nigeria person that those guys are Indians and they have right to beat Nigerians and they can’t do anything to their citizen because of a Nigeria man……………….. Therefore, i use this opportunity to call on my fellow Nigeria back Home to know what Indians are doing to their fellow Nigerians in India and also advise you guys to know how to handle Indians in Nigeria and pay them back because without teaching the India citizen in Nigeria a lesson…. The police and their citizens here in India will continue killing Nigerians here in India without fear knowing that Nigeria Government will not do anything to them……… 90% of Nigerians here has a valid visa, but police did not care neither their fellow citizens and they refuse to rent us a house and always asking us to go back to Nigeria or face death………………… INDIANS ARE WICKED AND HEARTLESS AND THEY HATE NIGERIANS AND THEY KILLED NIGERIANS EVERY MONTH OR WEEKS HERE AND OUR EMBASSY AND GOVERNMENT IS NOT DOING ANYTHING REGARDS TO THAT AND THAT IS THE REASON AM CALLING ON MY FELLOW NIGERIA TO KNOW HOW TO HANDLE INDIANS IN NIGERIA AND PAY THEM BACK WHAT THEY DESERVE AS WICKED AND HATED PEOPLE.

    It is indeed a pitiable situation that the Nigerian Judiciary has been exposed to odium and ridicule. If not,give me a good reason why Access Bank would prefer to institute an action in an English court in London instead of here in Nigeria. The reason is not far fetched,its because of the likes of Justice Obong who is presiding over this matter in Lagos,why was he so in a haste to give a restraining order against Access Bank? Access Bank Chiefs,please I encourage you to use every medium possible to recover your money from this squandermania called ifeanyi uba…

      More greese to your elbows, Access Bank. Insist on the London court because Nigeria has no judiciary system. The Obong of a man is in the cesspool of fraudulent judicicry officers in Nigeria. Is there any provision in the constitution that justifies his order? If he trying to protect the Nigerian judiciary, he should start from calling his peers to order. Who knows how much Capital Oil and Uba paid mhim to give a useless order. By the way, what is Capital Oil afraid of in answering the suit in a London court. Was it not a London court that put James Ibori in jail? Did the Nigerian senate or government protest his incaceration in London? So why this stupid order to withdraw the London suit emanating from Mr Obong. Access Bank believes they are right and wants justice, not Nigerian crooked justice. Access Bank wants to be paid fully by Capital Oil for the loan, and not do a write-off like all other corrupt Nigerians who don’t pay back loans. Justice must prevail.

    Nigeria Judiciary is on the path of destruction. That useless judge claimed he banged a 2yr jail with an optional N750K fine on the Pension thief Yusuf bc Nigeria law did not stipulate a mimimum. That’s after admiting he stole N23B. Why did he not fine N30B then. Nigerian judges are all thieves – either they’ve stolen in the past, stealing right now or will steal in the future. Ibori was set free here but jailed in UK. Same is playing out here. Access Bank is a global corporation can can institute any case from any where. I’m sure this bank loan thief Ubah won’t want to visit UK or EU for now!

    To say Nigeria Judiciary is on the path of destruction is a gross understatement, your methodology didn’t capture much of the effects, I guess you should an advanced estimation approach. By the way, the rich have raped the system. In fact, the Judiciary has no real effects on the people, and the little oscillation it does swings for the moneybags. We are on a journey of no end in sight.

    Assets bank is merely seeking for justice which they know they can’t get in Nigeria hence the london suit.they are right.I advice the EFCC,SSS,ICPC etc to start filing their cases in foreign courts if JUSTICE is what they want.
