A Lokoja High court, on Friday, ordered that Senator Dino Melaye representing Kogi west Senatorial District be moved immediately to the National Hospital, Abuja, for treatment due to his critical state of his health.
A magistrate court had on Thursday ordered the remand of the Senator and two others till June 11,on charges bordering on criminal conspiracy and illegal possession of firearms.
But Melaye appealed against the ruling at the high court.
Two separate applications filed by Melaye’s lead counsel, Mike Ozrkhome SAN, prayed the court to set aside lower court ruling and grant bail to his client or give an order for his client to be moved to the National Hospital, Abuja for adequate treatment.
The counsel however said the commissioner of police Legal evaded to be served copies of his application on the ground that he must be served in Abuja.
The respondent also filed an application to the high court praying the court to remand Melaye in the prison custody instead of police custody.
In his ruling, the trial judge who is the state Chief judge, Justice Nasir Ajana, frowned at the behaviour of the commissioner of police Legal, who refused to be served saying for somebody who is representing the Inspector- General of Police to behave in such way does not give good image to the police.
The judge however said he couldn’t grant the bail application now because the respondent has to be served.
But he acceded to the second prayer, which sought for Melaye to be taken to the national hospital for adequate treatment saying, “only the living can stand for trial”
He therefore adjourned the case to Monday to hear the application for bail.
